SPEED-GEEKS TERMS OF USE

Effective: January 30, 2025

1. Acceptance of the Terms of Service

Speed-Geeks (“we” or “us”) provides its website and related services (the “Service”) to users (“you” or “User”), subject to these Terms of Service (“TOS”). By accessing or using the site, you agree to be bound by this TOS and our Privacy Policy. If you do not accept these terms, do not use the site.

We reserve the right to modify this TOS at any time. Changes will take effect immediately upon posting, and continued use of the site constitutes acceptance of the revised TOS.

2. Eligibility

You must be at least 18 years old to use this site. In jurisdictions where the minimum legal age is higher, you must meet those requirements.

Some betting-related content may only be available to users 21 years or older and located in jurisdictions where sports wagering is legal. This site is for informational purposes only and does not facilitate real-money betting.

3. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data.

4. Description of Service

Speed-Geeks provides users with motorsports analytics, race outcome simulations, daily fantasy sports and betting insights, rankings, lineups, and other related content (“Content”). The Service includes interactive features such as a Discord community and premium content.

Speed-Geeks does not accept bets or facilitate gambling transactions. Any wagering decisions made based on site content are at users’ own risk.

Speed-Geeks primarily provides coverage for all NASCAR Cup Series races (excluding exhibition events) and most Xfinity and Truck Series races, subject to scheduling constraints. Coverage is not guaranteed for every event.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

5. Subscription & Refund Policy

Speed-Geeks offers Yearly, Monthly, and Weekly subscription plans. All sales are final, and no refunds will be issued. However, users may contact us directly for refund considerations at our discretion.

6. User Conduct

You agree not to:

Violate any applicable laws or regulations.
Share your account credentials with others.
Post or transmit malicious content (e.g., viruses, spam, illegal material).
Use site content for commercial purposes or to compete with Speed-Geeks.
Scrape, mine, or automate data collection from the site without permission.
Share paid content for upcoming races; however, sharing of completed race content is allowed.

Failure to comply may result in account suspension or termination.

7. Intellectual Property

All content provided by Speed-Geeks, including but not limited to articles, analytics, tools, and proprietary data, is protected by copyright and trademark laws.

Users may not copy, distribute, or repurpose Speed-Geeks’ content for commercial purposes without prior written consent.

Entities involved in sports betting, daily fantasy sports, or similar industries are prohibited from accessing Speed-Geeks content for competitive or commercial use.

Unauthorized use of site content may result in liquidated damages of up to $25,000 per violation, in addition to other legal remedies.

8. Limitation of Liability

Speed-Geeks is not responsible for:

Financial losses resulting from reliance on site content.
Errors, inaccuracies, or outdated information.
Third-party advertisements, services, or promotions.

Users assume all risks associated with betting, fantasy sports, or other gambling-related activities.

9. Disclaimer of Warranties

The site and its content are provided “as is” without warranties of any kind. Speed-Geeks does not guarantee:

The accuracy, completeness, or reliability of content.
That the site will be error-free or uninterrupted.
That user outcomes will align with any predictions or projections.

Speed-Geeks is not liable for decisions users make based on site content.

10. Indemnification

Users agree to indemnify Speed-Geeks and its affiliates against claims, damages, or liabilities resulting from site usage, including violations of these Terms.

11. Third-Party Content & Promotions

The site may display third-party advertisements and promotions. Any interactions or transactions with third parties are solely between the user and the third party. Speed-Geeks assumes no responsibility for such engagements.

Speed-Geeks may participate in affiliate programs with sportsbooks or DFS providers in the future. Any affiliate relationships will be disclosed where applicable.

12. Account & Access Management

Users are limited to one account per person. Speed-Geeks monitors IP addresses to prevent unauthorized multi-accounting. Accounts found in violation may be terminated.

VPN users are not explicitly restricted, but Speed-Geeks reserves the right to take action against suspicious activity.

13. Account Termination

We reserve the right to terminate or suspend user access at any time, with or without notice, for violations of these Terms or other reasons at our discretion.

Terminated users will not receive refunds or credits for any remaining subscription periods.

14. Notices

Official notices can be sent to joe@speed-geeks.com. Users must keep their contact information updated.

15. Governing Law

These Terms are governed by the laws of the State of Massachusetts. Any disputes shall be resolved exclusively in the courts of Essex County, Massachusetts.

16. Miscellaneous

Users may not assign their rights under these Terms.
No third party has enforcement rights under these Terms.
If any provision is found invalid, the remaining provisions remain enforceable.
Failure to enforce a provision does not waive Speed-Geeks’ rights.

17. Entire Agreement

These Terms, along with the Privacy Policy, constitute the entire agreement between Speed-Geeks and users, superseding all prior agreements.

18. Modification

We reserve the right to modify these Terms at any time. Continued use of the site after modifications constitutes acceptance of the updated Terms.

19. Responsible Gaming Notice

Speed-Geeks is not affiliated with NASCAR or any official racing organizations.
